Many people who move to Spain assume they become tax resident when they receive their residence card. That is not how it works. Tax residence follows its own rules, and it can begin earlier, or later, than the date on your card.
Your residence card and your tax residence are two different things.
Once you are resident, Spain taxes your income from anywhere in the world.
When are you tax resident in Spain?
You are tax resident in Spain for a calendar year if you spend more than 183 days in the country during that year, or if the main centre of your activities or economic interests is here. Sporadic absences count as time in Spain unless you prove tax residence in another country. There is also a presumption: if your spouse, not legally separated, and your dependent minor children live in Spain, you are presumed to be resident too, unless you prove otherwise.
What residence means in practice
Being resident means that your Spanish income tax return covers your worldwide income, including:
- Salaries or fees from clients abroad.
- Interest and dividends from accounts and investments in your home country.
- Rental income from property you still own there.
- Gains on the sale of assets, wherever they are.
Double tax treaties prevent the same income being taxed twice, but they do not remove the obligation to declare it in Spain.
An example: the year of transition
A professional arrives in Madrid in October. That first year she spends only a few months here and remains resident at home. The following year she lives in Madrid from January to December, but keeps filing only in her home country, out of habit. For that second year she is already Spanish tax resident, and the Spanish return for it is still outstanding. It is the most common situation we see, and it is easy to put right if it is identified early.

A note for United States citizens
The United States taxes its citizens wherever they live, so a US citizen resident in Spain deals with two systems at once. The treaty between both countries allocates taxing rights and provides relief for double taxation. We advise on the Spanish side; the US filings should be handled by a US adviser, and both should be coordinated.
